1.These terms
These terms are an agreement between you and Safyah Solutions ("we", "us") for your use of the Safyah Rewards app and website (the "Service"). By creating an account or using the Service, you agree to them and to our Privacy Policy. If you don't agree, please don't use the Service.
Businesses that run programmes on Safyah Rewards agree to separate Merchant Terms.
2.Who can use it
You must be at least 13 years old. If you are under the age of majority where you live, you need a parent or guardian's permission, and they accept these terms for you.
3.Your account
- You sign in with a code we email to you, or with Google or Apple. Keep access to that email address and those accounts secure, because anyone who can reach them can sign in as you.
- Give your real name. Businesses see it when they scan your code or look you up.
- Your account is personal. Don't share it, sell it or let someone else collect points on it.
- Tell us straight away if you think someone else has used your account.
4.How programmes work
Safyah Rewards is a platform. Each loyalty programme, and every reward in it, is offered by the business that runs it, not by us. That business decides how points are earned, what rewards cost, whether points expire, any cap on your balance, and who may join. It may change those rules, pause the programme or end it.
Questions about a purchase, a reward or how a business applied its rules are between you and that business, though we are happy to help where we can.
5.Points
- Points have no cash value. They can't be exchanged for money, transferred to anyone else, or combined across businesses, and they are not your property.
- Our servers keep the score. Points are worked out by the Service from the business's rules. The balance in the app is the official balance.
- Points may expire if a programme sets an expiry period and you have no activity there for that long. The app shows when your points are due to expire and we try to warn you beforehand, but you lose them on the date either way.
- Corrections happen. A business may add or remove points to fix a mistake. Every change is recorded on your card.
- Ending a programme. If a business ends its programme, leaves Safyah Rewards, or closes, its points may no longer be redeemable.
- Misuse. Points gained by fraud, error or breaking these terms may be removed.
6.Redeeming rewards
When you have enough points, you can ask to redeem a reward. You'll get a short code that staff confirm at the counter, and the points come off when they do. Unconfirmed requests expire after a few minutes. A business may refuse a redemption it can't honour, for example when a reward is out of stock, and in that case no points are taken. Rewards are subject to any conditions the business sets.
7.Location and counter check-in
Nearby and counter check-in use your device's location and Bluetooth only as described in our Privacy Policy. Counter check-in is optional. It lets staff find you more easily but is not proof of a purchase or a visit, and points are awarded only when a business records them.
8.Fair use
You agree not to:
- copy, share or fake the code shown at the counter, or try to earn points you're not entitled to;
- interfere with the Service, probe it for weaknesses, or access it by automated means other than our apps;
- reverse engineer the apps, except where the law allows it;
- harass businesses or their staff, or use the Service for anything unlawful.
9.Ending your use
You can stop using Safyah Rewards and delete your account at any time in the app under Account → Delete account. Any points you have are lost when you do. We may suspend or close an account that breaks these terms or puts the Service or others at risk, and we will tell you why unless the law or safety prevents it. We may also stop offering the Service, giving reasonable notice where we can.
10.Our service and content
The apps, website and our branding belong to Safyah Solutions. We give you a personal, non-transferable licence to use the apps for their intended purpose under these terms. Businesses' names, logos and descriptions belong to them.
11.Disclaimers
We work hard to keep Safyah Rewards running and accurate, but the Service is provided "as is" and "as available". To the extent the law allows, we make no promises that it will be uninterrupted or error-free, and we are not responsible for the goods, services or rewards businesses provide. Nothing in these terms limits rights you have as a consumer that cannot be limited by contract.
12.Limitation of liability
To the extent the law allows, Safyah Solutions is not liable for indirect or consequential losses, or for lost points or rewards, and our total liability to you for any claim about the Service is limited to US$50. This does not limit liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
13.App stores
If you downloaded the app from the Apple App Store or Google Play, these terms are between you and us, not Apple or Google, who are not responsible for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. You must also follow the store's own terms.
14.Changes to these terms
We may update these terms as the Service changes. We will post the new version here with a new date and, for significant changes, tell you in the app or by email before they take effect. If you keep using the Service after that, the new terms apply.
15.Governing law
These terms are governed by the laws of Saint Vincent and the Grenadines, and its courts have jurisdiction over any dispute, unless the law where you live gives you the right to bring a claim in your local courts.
